

I thought this was totally fair and made sense, but then I got the call from them to call HPD and things went south. They believed I would pass HPD and just have to pay an overage charge for my first year since my 2018 income was artificially high. They called me in for a second visit to have me sign the overage charge they calculated based on my 2018 income (it wasn't bad, something like $80 over the original maintenance charge of $648 or so). On my initial visit I brought in 3 years of tax returns (2016, 17, 18) and a letter from my accountant stating what my projected income would be for 2019, and everything looked good to them. James said they thought they could let me in the building as a first time cooperator/new person to the building because my 3-year average income was under the income limit. He thinks HPD would have overlooked my high income year and taken my average 3 year income under consideration to let me in if this happened a few years ago, but not this year. As a result he said HPD is being extra careful about screening applicants. He said that as of mid-last year (2019), HPD was under a TON of scrutiny with all the bad press/audit results that became public.

When my rejection winds started blowing I called him again and he took my call. He didn't give any specifics on what it's like inside, but it was nice to hear that it's well run. He is also somehow involved with GG and said it was a really well-run coop, and a good place to be. Before I discovered this forum I contacted a lawyer familiar with Mitchell Lamas (he's the one quoted in a few articles in Brick Underground) to see if he'd answer general questions, and he was really helpful. Hi shady, thanks for the good vibes on my appeal, I appreciate it! Did you ever bring this up to them? It's even in the Mitchell Lama rules outlined by NYC. I'm so perplexed! Because MLs are allowed to let people in whose rent is higher than the limits and they will just charge them a surcharge. I'm appealing the decision and have my fingers crossed I get reinstated on the list. James Towers but got rejected because of my income being a little too high (I'm a freelancer and my income varies from year to year, they don't average out 1099 income for freelancers like they do in other lotteries).

She also confirmed that I'm still on the list I asked if she had any idea how long my wait time might be and she said it could be this year, could be next year, but it all depends on how vacancies go. She said that they've finished the old one-bedroom waiting list, and are up to #2 on the current one.
